These Terms and Conditions (“Terms”) govern the sale of products through bricoshop-europe.com (the “Website”), operated by CAPITALADV S.R.L., trading as Bricoshop Europe (“we”, “us”, “our”). Please read them carefully before placing an order. By placing an order you confirm that you accept these Terms.

  SBC Performance LLC, Wyoming, United States, provides advertising, campaign management and marketing support services on behalf of CAPITALADV S.R.L.

  SBC Performance LLC acts solely as a marketing service provider and does not operate the Website, act as the seller, or enter into sales contracts with customers.

2. Definitions

• “Consumer” means a natural person acting for purposes outside their trade, business, craft or profession.
• “Products” means the goods offered for sale on the Website.
• “Order” means your request to purchase Products from us.
• “Contract” means the contract of sale between you and us for the Products.

3. Acceptance of these Terms

By using the Website and placing an Order, you agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy and Refund & Returns Policy, which are incorporated by reference. If you do not agree, please do not place an Order.

4. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to place an Order. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete.

5. Products, descriptions and availability

We take care to describe and picture our Products accurately. However, images are for illustration only, and slight variations in colour, packaging or minor detail may occur. All Products are subject to availability. We may withdraw a Product, or correct an error in its description or price, at any time before your Order is accepted.

6. Prices and taxes

• Prices are shown on the Website in the currency indicated at checkout and are subject to change, but changes do not affect Orders we have already accepted.
• Unless stated otherwise, prices for consumers include applicable value-added tax (VAT). Where an Order is shipped internationally, additional import duties or taxes may apply and are described in our Shipping Policy.
• Any delivery or cash-on-delivery charges are shown separately before you confirm your Order.
• If we discover an obvious pricing error, we are not obliged to supply the Product at the incorrect price and will contact you before proceeding.

7. How a Contract is formed

Your Order is an offer to buy. After you place an Order, we will send you an acknowledgement confirming that we have received it; this acknowledgement does not by itself form a Contract. The Contract is formed only when we confirm that your Order has been accepted or when we dispatch the Products, whichever happens first. We reserve the right to decline any Order, for example where a Product is unavailable, where we cannot obtain authorisation for payment, where we suspect fraud, or where there has been a pricing or description error.

8. Payment

We accept the payment methods displayed at checkout, which may include cash on delivery (COD) and, where offered, secure online payment. Where you choose cash on delivery, you agree to pay the full amount (including any applicable charges) to the courier at the time of delivery. Online payments are processed by third-party payment providers; we do not store your full card details.

9. Delivery

We deliver to the destinations, and within the timeframes, set out in our Shipping Policy, which forms part of these Terms. Delivery times are estimates and are not guaranteed unless expressly agreed. Risk in the Products passes to you on delivery.

10. Right of withdrawal for EU/EEA consumers

If you are a consumer in the EU/EEA, you have the right to withdraw from your Contract within 14 days of receiving the Products, without giving any reason, in accordance with Directive 2011/83/EU on consumer rights. Full details of how to exercise this right, the conditions, and the refund process are set out in our Refund & Returns Policy, which includes a model withdrawal form.

11. Legal guarantee of conformity

Where you buy as a consumer in the EU/EEA, the Products benefit from the statutory guarantee of conformity: we are liable for any lack of conformity that becomes apparent within two years of delivery, in accordance with Directive (EU) 2019/771 and the consumer-protection law of your country. If a Product is faulty, not as described, or not fit for its purpose, you are entitled to have it repaired or replaced and, where appropriate, to a price reduction or a refund. These statutory rights are not affected by any commercial warranty we may offer or by these Terms.

12. Returns and refunds

Your rights to return Products and receive refunds — whether under the right of withdrawal or the legal guarantee — are described in detail in our Refund & Returns Policy.

13. Your responsibilities and acceptable use

• You agree to provide accurate delivery and contact information and to be available to receive delivery.
• You agree not to use the Website for any unlawful, fraudulent or abusive purpose, not to place speculative or false Orders, and not to interfere with the Website’s operation or security.
• You agree not to reproduce, copy or resell any part of the Website except as permitted by law.

14. Intellectual property

All content on the Website — including text, graphics, logos, images, product descriptions and the “Bricoshop Europe” brand — is owned by or licensed to us and is protected by intellectual-property laws. You may not use it without our prior written permission, except as necessary to use the Website for its intended purpose.

15. Our liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for the statutory rights of consumers. Subject to that, we are not liable for losses that were not foreseeable, for losses not caused by our breach, or for business losses where you use the Products for any commercial purpose. Our total liability arising out of any Contract shall not exceed the price paid for the relevant Products, except where a higher amount is required by mandatory law.

16. Events beyond our control (force majeure)

We are not responsible for any failure or delay in performing our obligations where that failure or delay is caused by events beyond our reasonable control, such as natural disasters, extreme weather, epidemics, strikes, transport disruption, failure of utilities or communications networks, or acts of government. We will take reasonable steps to minimise the effect of any such event.

17. Complaints and dispute resolution

We want you to be satisfied. If you have a complaint, please contact us first at support@bricoshop-europe.com so we can try to resolve it. If we cannot resolve your complaint directly, EU/EEA consumers may be able to use an alternative dispute resolution (ADR) body in their country, or seek assistance from the European Consumer Centres Network (ECC-Net) for cross-border purchases. (The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available.)

18. Governing law and jurisdiction

These Terms are governed by the laws applicable at our place of business, without prejudice to the mandatory consumer-protection rules of the country in which you habitually reside. If you are a consumer in the EU/EEA, you benefit from, and may bring proceedings under, the mandatory provisions of the law of your country of residence, and nothing in these Terms deprives you of that protection.

19. Changes to these Terms

We may amend these Terms from time to time. The version applicable to your Order is the one in force at the time you place it. Please review the Terms each time you order.

20. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce a right is not a waiver of that right. You may not transfer your rights under a Contract without our consent; we may transfer ours where your rights are not affected.
